Terms

The short version

These terms are an agreement between you and Patch ("Patch", "we", "us") for using the Patch app and hellopatch.app (together, "Patch"). By creating an account or using Patch, you agree to them and to our Privacy Policy. If you don't agree, please don't use Patch.

1. Who can use Patch

You must be at least 13 years old, or older if your country requires it, to use Patch. If you're under the age of adulthood where you live, a parent or guardian must agree to these terms for you. You can't use Patch if we've previously removed your account, or if the law doesn't allow you to.

2. Your account

Give accurate information and keep your sign-in details safe. You're responsible for what happens on your account. Tell us at support@hellopatch.app if you think someone else has used it. Handles that impersonate someone or that we need to reclaim (for example a trademark) may be changed.

3. What you post

You keep ownership of the photos, videos, patterns, text and other content you post.

So that we can run Patch, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and distribute your content on Patch, and to show it to the people your settings allow. This license is only for operating, improving and promoting Patch within the app and on hellopatch.app. It ends when you delete the content or your account, except for content others have already built on or shared in conversations (as described in the Privacy Policy), copies in backups for up to 90 days, and where we need to keep it for legal reasons.

Only post content you have the right to post. If you share a pattern or design that isn't yours, credit its designer and respect their terms. Don't upload paid patterns you don't have permission to share.

4. Community rules

Patch is made for a kind community. Don't:

Use Report on a post, comment, project, profile or message to tell us about something that breaks these rules.

5. Moderation

We may review, hide or remove content, and limit, suspend or close accounts, that break these terms or put people at risk. When we act on your content or account, you'll see why in Settings › Safety, and you can ask for another review within 30 days. Someone other than the person who decided will look at it.

6. Copyright complaints

If you believe content on Patch infringes your copyright, email support@hellopatch.app with: your contact details; a description of your work; where the content is on Patch; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and you're the owner or authorized to act for them, with your signature. We remove infringing content and close the accounts of repeat infringers.

7. Beta

Patch is in beta. Features may change, be added or be removed, and some (such as swaps and sales) aren't available yet. There may be bugs or interruptions. We back up regularly, but please keep your own copies of anything important; you can download your data at any time.

8. Patch's part

Patch, its name, logo, design and software belong to us. We give you a personal, non-transferable right to use Patch under these terms. Don't copy, modify or reverse-engineer it except where the law allows. If you send us feedback or ideas, we may use them without owing you anything.

9. Other people and other services

People on Patch are responsible for what they post and do, and we don't check everything before it appears. Patch may link to or work with other services (such as Google, Apple or Ravelry), which have their own terms.

10. Ending things

You can stop using Patch and delete your account at any time in Settings › Account and data. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering Patch; where we reasonably can, we'll tell you first and give you a chance to download your data.

11. Disclaimers

Patch is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and we don't promise Patch will be uninterrupted, error-free or that content on it is accurate (including patterns, yarn amounts and instructions shared by other people).

12. Limits on liability

To the extent the law allows, Patch won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Patch. Our total liability for any claim about Patch is limited to the greater of US$50 or the amount you paid us in the 12 months before the claim (Patch is currently free). Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have that can't be limited by law.

13. Indemnity

If someone makes a claim against us because of content you posted or your breaking these terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.

14. Law and disputes

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Disputes will be decided in the state or federal courts in California, unless the law where you live gives you the right to bring a claim in your local courts. If you're a consumer in the EU or UK, you keep the protections of your local law. Please contact us first; most problems can be solved by email.

15. Changes

We may update these terms. We'll change the date above, and if the changes are significant we'll tell you in the app or by email before they take effect. If you keep using Patch after that, the new terms apply.

16. The rest

These terms and the Privacy Policy are the whole agreement between you and us about Patch. If part of them can't be enforced, the rest still applies. If we don't enforce something right away, we don't give up the right to later. You can't transfer these terms; we may transfer them as part of a merger or sale of Patch.
